General Policies
These rules and policies are for your benefit and protection.
Complete rules may be obtained at the office. If
you have any questions or comments regarding them, please feel free to contact the
Auction.
SUBJECT TO ARBITRATION
(Unless Declared)
1. Current model year only: Less than 10,000 miles. Visible defects,
defective windshields and body work must be announced (exception: minor touch up).
2. Utilized body damage, frame damage (beyond superficial dents and
scrapes), rotted out or frame repair must be announced. Frame damage,
rotted out or frame repair not announced, must be reported and returned for
inspection to the Auction within one (1) week from date of
purchase.
Frame damage from normal use (scratches, scrapes, jacks or lift marks, minor
corner tie down marks not resulting from accidents) is not grounds for
rejection.
3. Any defect subject to arbitration not announced must be
reported to the arbitration office within ONE (1) HOUR.
A. Motor, Clutch, Front & Rear
Differential, Transmissions.
B. Air Conditioning (7-Model years or
newer).
C. Any unit unsafe to operate on highway
will be rejected.
D. Any single mechanical defect which
exceeds $500.00 to repair.
E. Altered or removed emission equipment
(7-Model years or newer).
F. Any accepted adjustment is
automatically an "AS-IS" transaction (including frame).
NOT SUBJECT TO ARBITRATION
1. 2002 and older windshield and windows; body
& paint work.
2. Uphosltery; headlinings; mats; convertible tops.
3. Leaking and wet transmissions (Exception: excessive pouring
leaks, front-wheel drive and four-wheel drive units).
4. Obvious visible defects.
5. Factory Options (Exception: air conditioning).
LIGHT SYSTEM
Green Light-"sound"
Selling dealer declares car is subject to all arbitration policies.
Unit
must be safe to operate to classify as "sound". No single
mechanical defect exceeding $500.00 repair.
Yellow Light-"defect"
Seller must announce any item subjected to arbitration, as well as any single
mechanical defect which exceeds $400.00 to repair, odometer defects or over
100,000 miles, non standard engines, transmissions and exceptions to original or
advertised production specifications for items deleted or added, including frame
damage.
White Light-"special condition"
Any announced conditions other than mechanical defects (i.e.:
repo-package
or over 100,000 miles).
Blue Light-"title attached"
Assignable title does not accompany car. Title may require up to
fourteen (14) days, excluding Saturdays, Sundays and national holidays for Buyer
to receive title. Title must be received by Auction within
fourteen (14) days, excluding Saturdays, Sundays and national holidays from
Seller. Buyer is cautioned not to spend any money on unit and not to
sell unit until title is received.
Buyers checks are deposited immediately by the Auction.
After the fourteen (14) day period, it is the buyer's option to return
the car or to wait a reasonable additional period of time for the title.
In the event that the title is not received by the Auction
within the fourteen (14) day period, special arrangements must be made with the
Auction before the unit is returned. The Auction must be notified
twenty-four (24) hours prior to the return of the unit for failure to receive
the title. If Auction has mailed title, buyers cannot return unit.
Red Light-"as is"
Sold with no arbitration.
Units subject to any and
all mechanical defects or repaired block. All units sold for $1,501.00 or
less become "as-is" units, including frame. Selling dealer must
announce under red light the following: police cars, taxi cabs, municipal cars,
fire cars, clips, salvage cars, flood cars, antiques, dune buggies, motorcycles,
motor homes, reconstructed vehicles and theft recovery vehicles. No
driving privileges.

OUTSIDE SALES
Outside sales are strictly between the buyer and seller and are
not binding on either until the sale is consummated. The Auction will not
become involved in any arbitration procedures or be responsible for any defects
on units sold outside of the sale, including frame.

ODOMETERS
Seller must announce if odometer is broken, replaced, altered or
in excess of 100,000 miles. The Auction will not become involved in
mileage disputes. Any irregularity in odometer must be brought to the
attention of the Auction management on the day of the sale. Seller is
responsible for the accuracy of mileage on all documents submitted to
office. Kilometers must be announced. If the vehicle is over
100,000 and TMU, it must be announced 100,000 and TMU.

BUYERS
Please examine all cars before bidding and be familiar with all
announced conditions of the unit. Cars should not be road tested until the
buyer has the proper sales receipts for release from the lot. Please
examine the serial number plate and the mileage reading before leaving the
sale. Pay for each car with a separate business check. Buyer assumes
responsibility for mechanical failure after leaving sale. Buyer must pay
for each unit within one (1) hour of purchase or file complaint.

SELLERS
Please have your units on the premises early on Friday morning,
avoiding the Friday last minute rush. Vehicles which are unsafe to operate
will not be run through the auction.

I.D. PLATES
Buyers and sellers should always use their I.D. plates to enter
their cars for sale and sign for purchase. Dealer who fail to use their
plates may delay the processing of their deals because they are illegible.
If you have lost your I.D. plate or it is badly worn, a new one will be made for
you at the main office upon request. Please help us to serve you better by
using your I.D. plate.

GENERAL POLICIES
1. All dealers must be licensed and maintain
current dealer tags through their state. All dealers must be registered
and approved to conduct business at Perryopolis Auto Auction.
2. All units over
$1501.00 purchased must be test
driven and settled within ONE (1) HOUR.
3. It is the seller's obligation to verify the
accuracy of the pre-printed information on the Auction Sales Invoice, as well as
the "Announced Conditions" and the "Block Condition Lights".
4. The buyer is obligated to carefully observe
the "Block Condition Lights", as well as understand the "Announce
Conditions". The buyer is also responsible for verifying the serial
number, model number, model year and mileage on all purchases before exiting
Auction property.
5. All titles submitted by the seller must be
in selling company's registered name.
6. All cars purchased and/or sold on the
Auction premises must be processed through the Auction office. Any dealer
found to be in violation of this policy will be prohibited from conducting
business at the Auction.
7. When "title attached" is not
announced at the block, the buyer has the right to reject the car.
8. All units sold for $1,501.00 or less
"as-is" (including frame and block) must be paid for
immediately. NO DRIVING PRIVILEGES.
9. No vehicle will be offered for sale without
a serial number plate.
10. Seller guarantees (unless declared) all
noted items which are subject to arbitration.
11. The Auction is not responsible for
warranty books or plates regardless of year, make or model. There is no
warranty implied to the accuracy of odometer reading.
12. The Auction does not guarantee the year of
any foreign car, house trailer, motor home, antiques, truck van, dune buggy,
motorcycle or ANY VEHICLE SOLD "AS-IS".
13. "IF' or "TRY" sales are
strictly between the buyer and the seller and are not binding on either until
the sale is consummated.
14. "Outside or Off the Block Sales"
are strictly between buyer and seller and are NOT BINDING ON EITHER until the
sale is consummated. The Auction will not become involved in any
arbitration procedures or be responsible for ANY DEFECTS on units sold outside
the sale, including frame.
15. Buyers and sellers must retain their copy
of the registration statement. This is your copy of the odometer
disclosure statement.
16. Units that appear to be equipped with
four-wheel drive and are not, must be announced as two-wheel drive units.
17. Any stipulation, promises or guarantees
made between buyer and seller must appear in writing on the "Bill of
Sale" before it may become a part of the transaction. The Auction
assumes no responsibility for any verbal commitments.
18. Defects in the mechanical condition of
Convertible Tops or Power Sunroofs shall not be subject to arbitration.
19. Any dealer who brings retail customers
will be asked to leave the auction and refrain from doing any further business.
20. Arbitration of all
matters concerning this Auction will be conducted by the management and its
decision WILL BE FINAL.
21. TMU means TRUE MILES UNKNOWN. You
are not stating that the vehicle has more than 100,000 miles or odometer not
working. By announcing "TMU", you are announcing that there has
been, at some point, a mileage discrepancy and the vehicle must be sold
"AS-IS".
ALL UNITS 10 YEARS OR OLDER ARE SOLD "AS-IS"
INCLUDING FRAME. NO ARBITRATION!
PLEASE CHECK THE "BILL OF SALE" FOR ALL ANNOUNCED
CONDITIONS, MAKE/MODEL, YEAR AND MILEAGE, BEFORE SIGNING.
ONLY PERRYOPOLIS AUTO AUCTION IDENTIFICATION CARDS WILL BE
ACCEPTED.

ATTENTION DEALERS
"Warranty Stickers"
ANY CAR THAT (1) Doesn't have a warranty sticker
(2) Has a warranty sticker that doesn't match the Vehicle Identification Number
(VIN) or
(3) Has a mutilated or illegible warranty sticker
MUST BE CHECKED BY THE PENNSYLVANIA STATE POLICE OR THE NATIONAL AUTO THEFT
BUREAU BEFORE IT CAN BE OFFERED FOR SALE AT PERRYOPOLIS AUTO AUCTION.

ATTENTION SELLERS
Although all vehicles selling for $1,501.00 or less are sold
"as-is" mechanically, it does restrict you from announcing a serious
mechanical problem. It is the seller's responsibility to know who was the
last bidder. Remember, your reputation is a treasured asset. Be fair
to your customer.

REPRESENTATION OF CARS
If the car is not property represented, file a complaint within
ONE (1) HOUR at the arbitration office and Get A Decision there before
leaving. Remember, all vehicles sold with over 100,000 miles are sold
"as-is" mechanically (including frame).

NO VISITORS
Dealers please do not bring any people other than absolutely
necessary to conduct your business. You are responsible for the actions of
your personnel at Perryopolis Auto Auction.

ATTENTION ALL DEALERS
All cars registered are subject to inspection by the State
Police, F.B.I. or the National Auto Theft Bureau. Do not register any cars
without a serial plate. Auction accepts no responsibility for vehicles,
including lost or stolen items, left on the premises unless prior storage
arrangements have been made.
